Return & Cancellations
What are my furniture cancellation rights?
If you are contracting with us as a consumer online or by phone, you have the right to cancel all or part of your order at any time up to 14 calendar days after the day on which you received the goods you ordered. You must take reasonable care of the goods while in your possession. You must inform us of the cancellation of the contract. Call (0044) 333 014 8000 or contact us via marksandspencer.ie to cancel and/or arrange return of the goods. This is not intended as a full statement of your rights under the Consumer Contract Regulations (CCR), including your right to a refund or exchange. For full details of your rights, further details are available online from your local Citizens Advice Bureau or your local authority’s Trading Standards department. The CCR does not apply to food, fl owers and plant gifts, made to order furniture or orders placed in store for made to measure curtains, blinds and cushions.
Can I return furniture?
Should you need to change your order, please contact our service team (0044) 330148000.If you amend your order, you may find there are changes to your delivery timescales and/or the price you pay for the item(s) (you will be charged the current selling price on the day you amend the order). You have a legal right to cancel your order within 14 days after the day on which you received your goods. All items returned must be in a reasonable condition and there will be a collection charge incurred of €75.
What if it doesn’t fit?
Ensure that there is enough space for your furniture to fit into your home and be built. You will receive a phone call 48 hours after your order and this will form part of the checklist for the call. If the item won’t fit, we reserve the right to recover €75 for handling costs.
How long will a refund take?
Please allow us 30 days from the cancellation date to process your refund. The refund will be credited to the card account used for the original purchase. Refunds for items returned under CCR will be processed within 14 days of receipt of the items to the specified address.
Limitation of liability
There are certain liabilities that we cannot exclude by law and nothing in these terms limits our liability for personal injury or death caused by our negligence or for fraud. You have certain rights as a consumer, including legal rights relating to faulty or misdescribed goods. For further information about your legal rights, contact your local authority’s Trading Standards department or your local Citizens Advice Bureau. Nothing in these terms will affect these legal rights and, in particular, we will perform our obligations under these terms with reasonable care and skill. Any products we supply to you will be of satisfactory quality. If we deliver a product to you that is not of satisfactory quality, you can contact us for a repair or replacement or, where this is not possible, a refund. We are responsible only for losses that are a natural, foreseeable consequence of our breach of these terms. We will not be liable to you if we are prevented or delayed from complying with our obligations under these terms by anything you (or anyone acting on your behalf) does or fails to do or due to events that are beyond our reasonable control. You must follow any advice we give you to keep products we supply to you safe (including any instructions or product manuals provided with the products). We cannot accept liability for damage to products we have supplied that is caused by your failure to follow this advice. In any event, we will not be liable for any losses related to any business of yours including (without limitation) lost data, lost profi ts, lost revenues or business interruption.
